Effective date: January 1, 2025 — Lafayette Concrete Company, licensed concrete contractor in Lafayette, LA since 2022.
By requesting a quote, signing a written estimate, or allowing Lafayette Concrete Company to perform any work on your property, you agree to these Terms and Conditions. These terms apply to all residential and commercial concrete projects performed by Lafayette Concrete Company in Lafayette Parish and the surrounding Acadiana region.
If you do not agree to these terms, do not submit a quote request or authorize work to begin.
All work performed by us is defined in a written estimate provided to you before construction begins. The estimate specifies the scope, materials, approximate square footage, project address, and total price.
Changes to the agreed scope of work must be documented in a written change order signed by both parties. We will not begin additional work outside the original scope without your written authorization.
Conditions discovered after work begins that were not visible or known at the time of the estimate (for example, buried debris, unstable subsoil, or existing underground utilities) may require a scope and price adjustment. We will notify you of any such changes before proceeding.
Payment schedules are specified in the written estimate. Typical projects require a deposit before work begins, with the remaining balance due upon substantial completion.
Accepted payment methods include check, cash, and bank transfer. Credit card payments may be accepted at our discretion and may be subject to a processing fee disclosed before payment.
Invoices not paid within 30 days of the due date are subject to a late fee of 1.5% per month on the outstanding balance, consistent with Louisiana Revised Statute 9:2781.
We reserve the right to place a materialman's lien or contractor's lien on the property in accordance with Louisiana lien law (La. R.S. 9:4801 et seq.) if payment is not received within the agreed terms.
Where a permit is required by Lafayette Consolidated Government or another applicable authority, we will obtain the permit before beginning work. Permit fees are either included in the estimate or itemized as a separate line item.
Work will not begin until all required permits are issued. You agree to provide reasonable access to the property for inspections required by the permitting authority.
If a project is delayed because a required permit was not issued through no fault of ours, the project timeline will be adjusted accordingly and we will not be liable for the delay.
You are responsible for ensuring that the work area is reasonably accessible at the scheduled time, including clearing the area of vehicles, furniture, animals, and other obstructions.
You represent that you have the legal right to authorize work on the property and that you are aware of any underground utilities, irrigation systems, or other improvements in the work area. Call 811 before any excavation is our standard practice, but you should also disclose any private utilities not registered with the 811 service.
We are not responsible for damage to unmarked private underground utilities, irrigation lines, or other subsurface improvements that were not disclosed prior to excavation.
Concrete pours are weather-dependent. We reserve the right to reschedule a pour date if weather conditions present a risk to concrete quality. We will notify you as early as possible if a delay is necessary.
Lafayette Concrete Company warrants that all concrete work will be performed in a workmanlike manner consistent with industry standards for the Lafayette, LA area for a period of one (1) year from the date of substantial completion.
This warranty covers defects in workmanship and installation. It does not cover:
Material warranties (such as warranties on concrete mix or sealer products) are governed by the respective manufacturer's terms and are passed through to you where available.
To make a warranty claim, contact us in writing at the email or address below within the warranty period. We will inspect the work and respond within 10 business days.
To the maximum extent permitted by Louisiana law, Lafayette Concrete Company's total liability for any claim arising out of or related to our services is limited to the amount paid by you for the specific project giving rise to the claim.
We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits, loss of use, or business interruption, even if we have been advised of the possibility of such damages.
We carry general liability insurance and workers compensation insurance as required by Louisiana law. A certificate of insurance is available on request.
Upon receipt of full payment, we will provide you with a lien waiver confirming that all amounts owed to us and to our subcontractors and material suppliers in connection with your project have been paid.
We will take reasonable steps to ensure that our material suppliers and any subcontractors we use are paid promptly so that no lien is recorded against your property without cause.
If a dispute arises between you and us in connection with a project, we agree to attempt to resolve it through direct negotiation first. If negotiation fails, the parties agree to submit the dispute to non-binding mediation before pursuing litigation.
These Terms and Conditions are governed by the laws of the State of Louisiana. Any litigation arising out of these terms will be brought in the courts of Lafayette Parish, Louisiana.
Lafayette Concrete Company and its employees and subcontractors are independent contractors and not employees or agents of you. Nothing in these terms creates a partnership, joint venture, or employment relationship.
These Terms and Conditions, together with the written estimate or contract signed by both parties, constitute the entire agreement between you and us regarding the project. They supersede all prior oral or written communications.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
We may update these Terms and Conditions from time to time. The version in effect at the time you authorize a project governs that project. Updates will be posted on this page with a revised effective date.
